Did you know that you have the right to challenge any information you believe that may be inaccurate, untimely, misleading, incomplete, ambiguous, unverifiable, biased or unclear!? These items are typically called questionable items. Called the Fair Credit Reporting Act—if a questionable negative item cannot be verified, then it must be removed. There are three major companies that buy and sell your credit information--Experion, AcquiFax and Trans Union. There three companies are not part of the government. They are businesses trying to make a profit just like a pizza shop or clothing store. Their product is your credit information. Since they profit by selling your information, you have the right to ensure it is verifiable. These laws exist for a reason. They are not just initials or phases that are around. The Fair Credit Reporting Act, the Fair Debt Collection Practices Act, the Fair Credit Billing Act, the Truth and Lending Act as well as a couple of others—get familiar with these laws and use these laws to protect yourself. For example, the next time the bureau says that a negative item must stay in your report for seven or ten years, they are either lying to you or they are misinformed. They cannot say how long an item stays on your report. Only the laws in the Fair Credit Reporting Act can determine that and proper item verification can determine the facts that they are using. The bureaus may stall or discourage you when you try to investigate items in your credit report. You will see a letter saying your request is frivolous that you cannot use a credit service or that they do not provide that information. You have to remember, they spend time and money investigating challenged information so it is not in their best interest to do so. You need to stay consistent. A lot of times, it takes a letter, a stamp and a little luck! You need to be persistent and persevere to get the results you want. The bureaus will try and stop you, but if you stay strong, you can get through it. It is legal to dispute items on your credit report. The Federal Trade Commission can give you more information on these laws. You can dispute them if you feel they are misleading, inaccurate or if you want them to be verified. Now, just imagine how much your credit score could improve if only half the inaccurate items were removed. There is no need to live in credit despair. You should always try and get your credit repaired to make your life happier. Just because your past credit may not have gone as expected—that does not mean that you cannot change your credit future. Getting declined now does not mean you cannot get approved in two, three or six months from now. Taking the initiative now can be your turning point in life.
